Privacy Policy

Introduction

We recognize the importance of protecting the information we collect from visitors to our site. We do not rent, sell, trade or share this information with anyone. It is our policy to use the information we acquire through the ordering, download and registration process for internal business uses only, and we maintain appropriate security measures to keep this information private.

We have updated our Terms and Conditions and this privacy policy to comply with the General Data Protection Regulation (GDPR) that comes into effect on May 25, 2018. This policy will disclose what information we collect from you, the reason that we collect it, and how long we will retain the data we have collected. If you have created an account on our site, you have the right to request a copy of that data, or request that we delete it.

Another aspect of this change is the requirement for explicit consent for us to collect and use the personally identifiable information you provide to us. This is why you must indicate you have read this policy and accept our Terms and Conditions for using this site. If you have any questions regarding this privacy policy, our contact information is listed below.

Personal Information

We collect information on website visitors, users who create an account on our website and those who purchase products from us. We collect the IP address, browser information, referring site and track usage for all visitors to our site. If you download one of our software products, we will also collect your name, email address and any additional information that you choose to provide, such as a company name. If you create an account on our site, we will also store your address, account preferences, purchasing options and a record of current and previous purchases that you have made on our website. We may also collect other information that you provide when you create or update your account information.

We collect your IP address, browser information and website usage statistics for data analysis, fraud and security monitoring, identifying usage trends and to ensure compliance with legal, regulatory and contractual obligations. Personally identifiable information such as your name, email address and physical address are used for business and marketing purposes. We also use this information to fulfill specific requests that you make through this platform, such as completing an order or responding to a technical support request.

We do not share, rent or sell the information collected from you to third parties. This information is only used for our own internal business purposes. Our products and services are marketed and sold to information technology professionals. They are not directed to people under the age of eighteen (18) and we do not knowingly collect information from them.

Accounts and Registration

You can create an account on our website, which is used to specify personal preferences and access certain areas of our website. When you download or install a new product, we will also ask you to provide your name and email address. If you choose not to create an account, register your products or provide personal information, you can still use most of the site. Some areas may be restricted to those users who have created an account with us and are a registered customer.

You may request that we remove your contact information so that you no longer receive messages from us, and you may request to have your account deleted. You may also request that we provide you with a copy of the personal data associated with your account on this website.

Request Removal

Please note that even if you request that we remove your account, we will continue to retain certain personally identifiable information including your order transactions, purchase history and product licensing information. We will retain only that information which is permitted and/or required for business and legal purposes.

Email and Social Media

When you create an account, place an order on our website, or download an evaluation version of one of our products, you must agree that you have read and accepted this Privacy Policy and agree to the Terms and Conditions of use of our website. You agree that when you provide us with your email address, you are giving us permission to contact you regarding those products, services or other transactions as part of the ongoing business relationship you have with us.

If you connect with us on social media, such as Facebook, Twitter or LinkedIn, you are agreeing to receive notifications, updates and promotions through that platform. We may use these platforms to send messages to you directly, or collectively as part of a group.

If you no longer wish to receive any communication from us, by email, through social media or any other form, you may request that we remove your contact information. Removing your contact information, or requesting the deletion of your account, will not affect your ability to receive purchase confirmation emails or responses to technical support requests.

If you have requested that we no longer contact you, and subsequently you place an order, submit a technical support request or make another inquiry, we will respond to you. However, our communication will be limited to that specific request. If you wish to resume receiving general product updates and other emails from us, please contact us.

Payment Processing

The information that you provide when you place an order on our website, including your credit card or bank number, the transaction amount and other personally identifiable information is collected by a third-party payment processor. We provide only the information required to process the payment transaction. We have no control over the third party’s use of your personal information, and we are not responsible for any disclosure made by a third party.

Payments that are made using a credit card are subject to fees and regulations as determined by the bank or organization that issued the card. For more information about how they use your personal information, refer to their Privacy Policy. Payments that are made through Paypal are subject to their User Agreement and Privacy Policy.

If you place an order on our website and then abandon that order, information about the products that were selected will be retained so that the order may be completed at a later time. However, we will not use the information you’ve provided to contact you until after the order has been completed.

Security and Data Retention

We use reasonable technical and administrative measures within our organization to protect your personal information from unauthorized access, misuse, alteration, deletion and public disclosure. Data is stored securely in data centers managed by Linode in the United States. Secure backup copies of the data are also stored remotely and retained as required for business purposes and by law for tax and legal purposes. For example, detailed purchasing information is retained for at least three (3) years to comply with tax regulations. Certain information that is required for the operation of the business, such as purchase history and product licensing information (including product serial numbers and contact information for the licensed owner) is retained indefinitely.

The criteria that we use to determine how long we will retain your information is based on how long it is needed or permitted, given the purpose for which it was obtained. This can vary, depending on how you use our website, and whether you are evaluating one of our products or if you are a customer who has purchased one of our products or services. The length of time that we retain your data may also be affected by legal and regulatory requirements, both in the state of California and in your state or country of residence.

Although every effort is made to protect your information, no server or data storage system is guaranteed to be completely secure. If you have any reason to believe that your account is no longer secure (for example, if you suspect that your account may have been compromised), immediately contact our Data Protection Officer using the contact information listed below.

We may use and disclose your personal information as necessary or appropriate, such as when we have a legal obligation or legitimate business interest to do so. The information that we collect may be used to investigate, prevent or respond to suspected illegal or fraudulent activity on our website, such as credit card fraud.

We will provide your personal information if requested or required by government authorities, such as law enforcement or court officials. We will disclose information about you in compliance with the law, both inside and outside of your country of residence. We may also use and disclose information that we have collected about you to protect our legal rights or defend against legal claims.

In the event that we choose to sell the company, or merge with another company, we may use, disclose or transfer your personal information as a result of corporate restructuring. This may include a sale, merger or transfer of assets in connection with any legal proceedings.
